Booking & Accommodation Service Provisions
First: Definitions
For the purposes of applying the provisions of this chapter, the following terms shall have the meanings assigned to each of them, unless the context requires otherwise:
Booking Service: An electronic service that allows users to display real estate units and complete accommodation bookings or short-term rentals through the platform.
Service Provider (Host): Every natural or legal person who owns, manages, or has a legal right to display and rent a real estate unit through the platform.
Beneficiary (Guest): Every natural or legal person who books a unit to benefit from it during the specified period.
Unit: The real estate, residential facility, or tourist facility displayed for booking through the platform.
Advertisement: All data, information, pictures, prices, and conditions published by the Service Provider regarding the unit.
Booking: The electronic contract created as soon as the booking request is approved and the financial consideration is paid in accordance with the provisions of this agreement.
Duration of Stay: The period specified in the booking, which starts from the check-in time and ends at the check-out time.
Financial Consideration: The total value of the booking including government fees, taxes, and any other amounts disclosed before completing the booking process.
Article 1: Obligations of the Service Provider (Host)
The Service Provider is committed to the following:
1. Ensuring their capacity and legal status that authorizes them to display and rent the unit, and assuming sole legal responsibilities resulting therefrom.
2. Adherence to all regulations, instructions, and licenses governing accommodation activities or short-term rentals.
3. Publishing correct and complete data about the unit, including location, description, pictures, prices, services, check-in and check-out times, and any special requirements, with a commitment to updating them as soon as any change occurs.
4. Enabling the beneficiary to utilize the unit according to the advertised data, and not modifying, replacing, or canceling it after booking confirmation, except with the beneficiary's consent or in cases approved by the platform.
5. Considering the booking confirmation as a binding commitment to implement all obligations contained in the advertisement.
6. Authorizing the platform to collect the value of bookings and deduct all fees, commissions, and regulatory amounts before transferring the financial dues to them.
7. Adhering to the cancellation and refund policy specified for the unit, and not applying any policy contrary to what is published on the platform.
8. Assuming full responsibility for any defect, deficiency, violation, or non-compliance in the unit or services provided therein.
9. The platform has the right to suspend the transfer of financial dues, perform a set-off, or deduct from them in the event of a dispute, claim, complaint, or suspicion of violation until verification procedures are completed.
10. If the action or negligence of the Service Provider results in the beneficiary's inability to benefit from the unit, or cancellation of the booking on their part, or if the unit differs materially from the advertisement, the platform may return the due amounts to the beneficiary and impose compensation on the Service Provider not exceeding four thousand (4,000) Saudi Riyals or the value of the booking, whichever is less. The platform has the right to deduct this compensation from any amounts or financial dues belonging to them without the need for additional consent.
Article 2: Obligations of the Beneficiary (Guest)
The Beneficiary is committed to the following:
1. Reviewing all unit data before confirming the booking, and the booking confirmation is considered final acceptance of all declared terms and data.
2. Paying the financial consideration in full according to the approved payment methods.
3. Adherence to the cancellation and refund policy applied to the unit.
4. Using the unit only for its intended purpose, and preserving it along with all its contents and facilities.
5. Assuming the value of any damages or losses resulting from them or their dependents during the period of stay.
6. Providing proof of identity upon request, and delivery of the unit may be refused if the identity data does not match the booking data.
7. Submitting any complaint related to the booking within a period not exceeding (48) hours from the end of the stay, otherwise they forfeit their right of recourse to the platform regarding it.
8. Consenting to enable the platform to disclose their data to the competent authorities or the Service Provider whenever required by regulations, or in the presence of a legal claim, violation, or damage resulting from the use of the unit.
Article 3: Obligations of the Platform
1. The platform's role is limited to operating and managing the electronic booking service, facilitating the completion of bookings, receiving payments, and transferring dues according to the approved financial policies.
2. The platform is not considered an owner, operator, or lessor of any displayed unit, and is not a party to the contractual relationship arising between the Service Provider and the Beneficiary.
3. The platform assumes no responsibility for the implementation of mutual obligations between the booking parties, or for the quality, safety, validity, or conformity of the unit to the published description.
4. The platform has the right to refuse, suspend, or cancel any advertisement, booking, or user account if it becomes aware of any violation of regulations or this agreement, or anything that may cause harm to the platform or others.
5. The platform does not assume responsibility for any damages or losses arising from force majeure, technical failures, government decisions, or any circumstances beyond its control.
6. All transactions executed through the booking service are subject to the laws of the Kingdom of Saudi Arabia, and any dispute shall be resolved by the competent judicial authorities within the Kingdom of Saudi Arabia.
