Electronic Correspondence
Article (110): Channels of Communication and Notifications
1- The platform may communicate with users through the electronic, digital, or technical channels it provides or adopts.
2- Communication channels and notifications include, but are not limited to:
- Email.
- SMS.
- In-app or platform notifications.
- Phone calls.
- Approved communication applications.
- Any other electronic channels approved by the platform.
3- The user commits to providing correct and updated contact details.
4- The user bears the responsibility to follow up on notifications and correspondence sent to them through approved channels.
Article (111): Legal Validity of Electronic Correspondence
1- The user agrees that all electronic correspondence, notifications, messages, and communications exchanged between them and the platform are legally binding when conducted through approved channels.
2- SMS, email, in-app notifications, and digital correspondence are considered valid means of proof in the relationship between the user and the platform to the extent permitted by applicable laws.
3- The user may not deny the validity or legal effect of electronic correspondence solely because it was generated, sent, or saved in electronic format.
Article (112): Electronic Approvals
1- Electronic approvals, acknowledgments, acceptances, requests, authorizations, or instructions issued by the user are binding on them when issued from their account or through channels associated with or approved by them.
2- The platform may rely on electronic approvals or instructions to execute services, procedures, or operations requested.
3- The user bears full responsibility for maintaining verification, authentication, and communication channels linked to their account.
Article (113): Communications Regarding Ads and Services
1- The platform may communicate with owners, real estate brokers, real estate offices, developers, entities, or their legal representatives regarding advertisements, requests, services, subscriptions, or marketing campaigns.
2- Correspondence, messages, calls, chats, or approvals exchanged between the platform and stakeholders serve as valid proof of the request, approval, authorization, or instruction issued regarding the service.
3- The platform may rely on such correspondence to manage services, ads, subscriptions, or execute related requests.
5- Marketing Communication and Publishing Authorization:
The platform has the right, as part of its current or future marketing and operational plans, to communicate with property owners, advertisers, beneficiaries, real estate brokers, entities, and potential clients through various channels, including phone calls, SMS, email, WhatsApp, social media, or any other electronic means, to offer services, attract advertisements, or provide marketing solutions.
If the client, advertiser, or legal representative consents, through any of the mentioned communication channels, to publishing the ad, re-marketing it, modifying its content or design, or uploading it to the platform, this consent is deemed a valid and legally binding electronic authorization. It empowers the platform and its representatives to enter the ad, upload its data, content, images, and information onto the platform, its applications, or marketing channels.
The advertiser or client declares that all data, information, documents, and licenses provided are valid, correct, and up-to-date, and that they bear full legal and regulatory responsibility for the ad's content, accuracy, and legality.
The platform assumes no responsibility for the ad's content, data, or disputes arising from it, provided the ad contains a valid advertising license number or official documents submitted by the advertiser. The platform's role is strictly limited to publishing, marketing, and electronic display based on the client's or advertiser's authorization.
6- The platform commits not to send marketing messages without obtaining the user's prior consent.
7- The user has the right to unsubscribe at any time through the following means:
- The unsubscribe link in marketing emails.
- Notification settings within the application or platform.
- Emailing support@aqarview360.com.
8- Sensitive data is never used for direct marketing purposes under any circumstances.
9- It is understood that unsubscribing from marketing messages does not affect essential operational notifications regarding the account or services.
Article (114): Electronic Records
1- The platform may retain electronic records, data, messages, correspondence, and approvals related to using services, executing operations, or managing accounts.
2- Electronic records kept by the platform or approved service providers are considered authoritative references for proving transactions, procedures, requests, approvals, or related dealings.
3- The platform may use these records for operations, protection, investigation, resolving disputes, or compliance with regulations and instructions.
Article (115): Accuracy of Contact Details
1- The user commits to keeping their contact details correct and continuously updated.
2- The platform assumes no responsibility for failure to receive notifications, messages, or alerts due to incorrect or outdated contact details or inability to reach the user's communication channels.
3- Notifications or correspondence are deemed correctly sent when directed to the contact details registered with the platform.
Article (116): Communication with Competent Authorities
1- The platform may disclose data, records, correspondence, or information when required by applicable laws, orders, decisions, or official requests issued by competent authorities.
2- Disclosure made in accordance with statutory requirements does not violate confidentiality or privacy obligations under this Agreement.
3- The platform reserves the right to cooperate with competent authorities to ensure compliance with laws and protect its rights, its users' rights, and its systems.
