General Provisions
Definitions:
For the purposes of applying these Terms and Conditions, the following words and phrases shall have the meanings assigned to each of them unless the context requires otherwise:
- Platform: Aqar View 360 Platform, including all its websites, applications, services, and current or future technical interfaces - An electronic platform that offers real estate and tourism services, managed and operated by the Operator. Its services are made available through its various websites and applications, including current websites and applications or any other digital channels added in the future, including but not limited to:
* Website: www.aqarview360.sa
* Application: Aqarview 360 on iOS and Android systems.
- Operator: Aqar View 360 Group registered in the Kingdom of Saudi Arabia, with its headquarters in Jeddah, or any legal entity that replaces it in the future.
- User: Every natural or legal person who uses the Platform or accesses its services by any means, whether registered or unregistered, including owners, real estate brokers, advertisers, buyers, tenants, property seekers, visitors, and any other person who benefits from the Platform's services.
- Account: An electronic record associated with the User created to benefit from services or features that require registration, verification, or management of electronic operations.
- Content: All data, information, texts, images, videos, audio recordings, maps, diagrams, designs, advertisements, messages, comments, files, and digital materials available on the Platform.
- Services: All electronic, real estate, technical, marketing, operational, financial, or support services provided by the Platform to Users, whether free or paid.
- Verified Account: The account that has passed the verification or authentication procedures approved by the Platform or relevant entities in accordance with the applicable regulatory requirements.
- Advertiser: Every natural or legal person who publishes a real estate advertisement, request, or marketing content on the Platform.
- Real Estate Broker: Every person or establishment legally licensed to practice brokerage, marketing, or real estate services.
- Real Estate Office: The licensed real estate establishment that uses the Platform to publish advertisements or provide real estate services.
- Owner: The natural or legal person who owns the property or has the legal right to dispose of it or advertise it.
- Real Estate Request: Any request to buy, rent, invest, develop, manage, or market a property published on the Platform.
- Third Parties: Any person, entity, institution, service provider, website, application, or system not directly affiliated with the Operator that is dealt with, linked to, or whose services are utilized through the Platform.
Article (1): Scope of Application
1. These terms, conditions, and all related policies and annexes are subject to the laws and regulations in force in the Kingdom of Saudi Arabia.
2. These terms and conditions apply to all platform users, visitors, and beneficiaries of its current or future services.
3. The use of the platform or any of its services constitutes a binding agreement to all provisions, policies, and instructions published on the platform.
4. Special terms for any service, product, or additional feature apply alongside these terms and conditions. In case of conflict, the specific terms of the service shall apply to the extent of such conflict.
Article (2): Nature of Platform Services
1. The platform provides an electronic and technical environment that enables users to benefit from real estate, marketing, technical, and related support services.
2. The platform may develop, modify, add, or cancel any service, feature, function, content, or operational tool at any time as it deems appropriate.
3. The platform is not obligated to continuously offer all services, features, or benefits permanently or without interruption.
4. The services, features, or benefits available may vary depending on the type of user, geographical location, subscription type, or regulatory and compliance requirements.
Article (3): Eligibility of Use
1. The user declares that they possess the necessary legal capacity to use the platform and enter into obligations related to the services provided.
2. Services requiring legal or contractual capacity may not be used by anyone under eighteen (18) years of age unless permitted by regulations or the service itself.
3. If the user is acting on behalf of another natural or legal person, they declare that they have the necessary legal authority to do so.
Article (4): Continuity of Services
1. The platform exerts reasonable care to maintain, improve, and develop the continuity of services.
2. The platform does not guarantee that the services will be absolutely free of interruption, malfunctions, delays, or technical errors.
3. The platform may temporarily or permanently suspend, restrict, or stop certain services for maintenance, development, or regulatory or security requirements.
Article (5): External Links and Services
1. The platform may contain links, references, or access methods to third-party websites, applications, or services.
2. These links are provided for convenience only, and do not constitute an endorsement, guarantee, or approval by the platform of these entities or their services.
3. Use of any third-party website, service, or application is subject to the terms, conditions, and privacy policies of that third party.
4. The user is responsible for verifying the suitability, safety, and reliability of any external party before dealing with them.
Article (6): Force Majeure
1. The platform shall not be held liable for any delay, failure, or interruption in performing its obligations due to circumstances or events beyond its reasonable control.
2. Force majeure cases include—but are not limited to—natural disasters, fires, floods, epidemics, wars, security disturbances, general communication and internet network failures, large-scale cyberattacks, and government decisions.
3. The execution of obligations affected by force majeure remains suspended for the duration of the condition to the extent execution is not possible.
Article (7): Modification of Terms and Conditions
1. The platform reserves the right to review, modify, update, or replace these terms and conditions or any part thereof at any time.
2. Modifications become effective from the date of their publication on the platform unless another effective date is specified.
3. The user's continued use of the platform or any of its services after modifications are published constitutes a final agreement and acceptance of them.
4. It is the user's responsibility to periodically review the terms and conditions to stay informed of any updates or changes.
Article (8): Approved Version
1. The electronic version published on the platform is considered the official and approved version of these terms, conditions, and related policies.
2. In the event of any discrepancy between the electronic version and any other version, the electronic version published on the platform shall prevail.
3. The invalidity or unenforceability of any provision of this agreement shall not affect the validity and enforceability of the remaining provisions.
